El rechazo de la demanda se dio porque el actor es menor de edad y, por tanto, carece de legitimación para ejercer la acción pública de inconstitucionalidad.
Para la Sala Plena de la Corporación resultó claro que, tal como lo advirtió el magistrado sustanciador en la providencia cuestionada, ostentar la calidad de ciudadano es indispensable para ejercer la acción pública de inconstitucionalidad.
